Terms of Use (CGU)
Purpose
These terms govern use of the Wywy application and service. By creating an account you accept them. They complement the Terms of Sale (CGV), which govern purchases.
Access to the service
The service is reserved for individuals aged 15 or over. Users under 18 must have the consent of a parent or guardian. One account per person. You are responsible for the accuracy of the information you provide, including your postal address, and for the confidentiality of your account.
Nature of the service
Wywy allows users to create a photograph and a message which are printed and sent by post as a physical postcard to another user. Once an order is confirmed, printing and posting occur within a short period and the card cannot be recalled, intercepted or modified.
Prohibited content
Users undertake not to create, send or publish any content which is: illegal under French law; sexually explicit or pornographic; involving minors in any sexual or suggestive context; violent, threatening or inciting violence; harassing, defamatory or degrading; inciting hatred or discrimination on grounds of origin, sex, sexual orientation, religion, disability or any other protected characteristic; infringing the intellectual property or image rights of a third party; or intended to deceive, defraud or send unsolicited commercial content. Users guarantee that they hold the necessary rights to any photograph they send, and that any identifiable person appearing in it has consented.
User responsibility
Each user is solely responsible for the content they create and send. Wywy is not the author of user content. Because the card is a physical object sent to a real address, users must ensure their sending is welcome. The sender is responsible for the address they enter and must be satisfied that their recipient is willing to receive mail from them. Anyone receiving a card can object at wywy.eu/stop; an address that has been opted out can no longer be used.
Reporting
Any user may report content they have received from within the application. Reported content and the identities of the parties are retained for review, as described in the Privacy Policy. Reporting cannot stop a card already printed and posted.
Blocking
Users may block another user, preventing them from making contact or sending postcards.
Moderation and sanctions
Wywy reserves the right, without notice, to refuse to print or send any order, to suspend or delete any account, and to report to the competent authorities any content which appears illegal. No refund is due for orders already produced.
Personal data
Processing of personal data is described in the Privacy Policy.
Amendments
These terms may be updated. Continued use of the service constitutes acceptance of the updated terms.
Governing law
French law. Disputes will be resolved amicably where possible, failing which the French courts have jurisdiction.
